FSA Letter (OCR 087), 20 October, 2010
Further to my letter of 28 September, I am writing to inform you that:
(a) Following the first quarterly review of Annex I to the above Regulation [see Note 1 below], Regulation (EU) 878/2010 amending Annex I has now been published in the Official Journal of European Union and is available at: http://eurlex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2010:264:0001:0006:EN:PDF. Regulation 878/2010 came into force on 7 October 2010.
(b) Following the second quarterly review, the Commission presented a proposal to amend the list of products in Annex I, at the meeting of the Food Chain and Animal Health (SCoFCAH) on 12 October 2010, which endorsed the recommendations.
Second Quarterly Review of Annex I
The amending Regulation presented at SCoFCAH on 12 October 2010 is attached [See link below] at Appendix 1. The text contains some minor linguistic corrections (in track changes), which do not affect the substance of the amendment attached to my letter dated 28 September 2010.
The amendments to Annex I are now subject to the scrutiny of the European Parliament. They are expected to enter into force on January 1, 2011. In particular, the proposed changes will concern mangoes from the Dominican Republic, trace elements (i.e. certain chemical substances suitable for use in feed and food in minimum quantity) from China and groundnuts from Brazil. The frequency of border controls currently applicable to these commodities will be lowered from 50% to 10%. Groundnuts from India, which are currently listed for the possible presence of aflatoxins, will have the relevant control frequency increased from 10% to 20%. Chilli products (curry) from India will be included in the list at Annex I, with the frequency of physical and identity checks set at 50%.
